DECLARATION OF ETHICAL PRINCIPLES (CODE OF ETHICS)

In addition to the ethical guidelines of the Pontifical Catholic University of Ecuador - PUCE (see Code of Ethics and the Code of Ethics of Research and Learning available https://www.puce.edu.ec/intranet/institutional/normativa) and recommendations and guidelines of the Publications Center and the Research Directorate (available at https://www.puce.edu.ec) the RFJ welcomes as the ethical foundation and good editorial practices the protocols established by the International Committee of Ethics in Scientific Publication - COPE (available at https://publicationethics.org/resources/code-conduct).

a.- Authors are obliged to participate in peer review process. The RFJ journal is a publication that adopts Open Science guidelines. Therefore, it is a continuous and biannual scientific publication (January-June) (July-December) published by the Publications Centre of the Pontificia Universidad Católica del Ecuador (EDIPUCE: https://edipuce.edu.ec/revistas/) and under the auspices of the University's Research Department 

b.- RFJ should expect that all authors have significantly contributed to their research and articles.

c.- All authors are obliged to provide retractions or corrections of mistakes.

b.- For the RFJ journal, the peer-review is defined as obtaining advice on individual manuscripts from reviewers’ expert in their specific fields.

10. NAME OF JOURNAL

The RFJ Journal is unique and not be one that is easily confused with another journal or that might mislead potential authors and readers about the RFJ Journal’s origin or association with other journals. The RFJ journal’s name refers to the Facultad de Jurisprudencia of Pontificia Universidad Catolica del Ecuador - PUCE. The PUCE’s Facultad de Jurisprudencia is the oldest Ecuador among private universities. Also, following the national legislation and regulatory guidelines in Ecuador, the RFJ has been registered as a PUCE’s “trademark” by the Servicio Nacional de Derechos Intelectuales – SENADI (March 21st, 2021 -Número de resolución: SENADI_2021_RS_3892. SPECIFIC EDITORIAL TEAM' RESPONSIBILITIES

Publication decisions

The RFJ’s Editorial Team is responsible for deciding which of the journal articles submitted to the RFJ journal will be published. The editorial team members will evaluate manuscripts without regard to the authors' race, gender, sexual orientation, religious belief, ethnic origin, citizenship, or political philosophy. The decision will be based on the articles’s importance, originality and clarity, and the study’s validity and its relevance to the journal's scope. Current legal requirements regarding libel, copyright infringement, and plagiarism should also be considered.

Confidentiality

The editorial team members and any editorial staff must not disclose any information about a submitted manuscript to anyone other than the corresponding author, reviewers, potential reviewers, other editorial advisers, and the publisher, as appropriate.

Disclosure and conflicts of interest

Unpublished materials disclosed in a submitted article will not be used by the editorial team members for their own research purposes without the author's explicit written consent.

Contribution to editorial decisions

The peer-reviewing process assists the editorial team members and the editorial board in making editorial decisions and may also serve the author in improving the journal article. Please visit: http://revistarfjpuce.edu.ec/index.php/rfj/about/editorialTeam

Promptness

Any selected referee who feels unqualified to review the research reported in a manuscript or knows that its prompt review will be impossible should notify the editor and withdraw from the review process.

Confidentiality

Any manuscripts received for review must be treated as confidential documents. They must not be disclosed to or discussed with others except as authorized by the editor.

Standards of objectivity

Reviews should be conducted objectively. Personal criticism of the author is inappropriate. Referees should express their views clearly with supporting arguments.

 

Acknowledgement of sources

Reviewers should identify cases in which relevant published work referred to in the journal article has not been cited in the reference section. They should point out whether observations or arguments derived from other publications are accompanied by the respective source. Reviewers will notify the editor of any substantial similarity or overlap between the manuscript under consideration and any other published journal article of which they have personal knowledge.

Disclosure and conflict of interest

Privileged information or ideas obtained through peer review must be kept confidential and not used for personal advantage. Reviewers should not consider manuscripts in which they have conflicts of interest resulting from competitive, collaborative, or other relationships or connections with any of the authors, companies, or institutions associated with the journal articles.

 

SPECIFIC AUTHORS' DUTIES

Reporting standards

Authors of original research articles should present an accurate account of the work performed as well as an objective discussion of its significance. Underlying data should be represented accurately in the journal article. A journal article should contain sufficient detail and references to permit others to replicate the work. Fraudulent or knowingly inaccurate statements constitute unethical behavior and are unacceptable.

Data access and retention

Authors could be asked to provide the raw data of their study together with the journal article for editorial review and should be prepared to make the data publicly available if practicable. In any event, authors should ensure accessibility of such data to other competent professionals for at least ten years after publication (preferably via an institutional or subject-based data repository or other data center), provided that the confidentiality of the participants can be protected and legal rights concerning proprietary data do not preclude their release.

Originality, plagiarism and acknowledgement of sources

Authors will submit only entirely original works, and will appropriately cite or quote the work and/or words of others. Publications that have been influential in determining the nature of the reported work should also be cited.

Multiple, redundant or concurrent publication

In general, journal articles describing essentially the same research should not be published in more than one journal. Submitting the same journal article to more than one journal constitutes unethical publishing behavior and is unacceptable.

Therefore, submitting an article means that it has not been published previously, that it is not being considered for publication in any other medium (except theses and degree works) or in any other language and that it is being submitted with the knowledge of all the authors. Failure to comply violates the ethical policies of the RFJ.

Manuscripts which have been published as copyrighted material elsewhere cannot be submitted. In addition, manuscripts under review by the journal should not be resubmitted to copyrighted publications. However, by submitting a manuscript, the author(s) retain the rights to the published material. In case of publication they permit the use of their work under a CC-BY-SA license 4.0. Authorship of the journal article

Authorship should be limited to those who have made a significant contribution to the conception, design, execution, or interpretation of the reported study. All those who have made significant contributions should be listed as co-authors.

The corresponding author ensures that all contributing co-authors and no uninvolved persons are included in the author list. The corresponding author will also verify that all co-authors have approved the final version of the journal article and have agreed to its submission for publication.

Disclosure and conflicts of interest

All authors should include a statement disclosing any financial or other substantive conflicts of interest that may be construed to influence the results or interpretation of their manuscript. All sources of financial support for the project should be disclosed.

Fundamental errors in published works

When an author discovers a significant error or inaccuracy in his/her own published work, it is the author’s obligation to promptly notify the journal editor or publisher and to cooperate with the editor to retract or correct the journal article in form of an erratum.

SPECIFIC POLICIES ON PLAGIARISM DETECTION

The contributions sent to the RFJ will be subjected to analysis of the URKIND automatic program (which allows the review of written works with the intention of revising their degree of similarity with other bibliographic sources). For more information visit: https://www.pucevirtual.edu.ec/urkund/.

Likewise, the guidelines and recommendations indicated by the Pontifical Catholic University of Ecuador - PUCE will be applied on its website (see https://www.puce.edu.ec) and the guidelines included in the organizational chart of the International Committee of Ethics in the Scientific Publication - COPE (available at https://publicationethics.org/resources/code-conduct).

In case of proven plagiarism the RFJ:

- Inform the editor of the journal in which the plagiarized document was published (totally or partially).

- Will inflict the authors of the plagiarized document.

- Publish an official retraction of the work.

- Will not publish any other work of the authors involved for a period of 5 years.

 

PLAGIARISM DETECTION PROCESS

The RFJ Law Journal will try to ensure that individuals and legal entities interested in the editorial process apply the basic ethical standards that govern scientific publications in general and ours in particular. For this, the declared ethical standards are followed and can be consulted on our website. In this sense, the RFJ submits the original articles received to the anti-plagiarism system with the URKUND and/or TURNITIN software, through the following steps:

 

1. Submission

The URKUND and/or TURNITIN process begins when a document is submitted to the system. This can be done through the school's existing learning platform or by attaching it to an email message. The system supports a wide variety of the most popular file formats, their standard word processors, and multi-document files when emailed. The text is then extracted from the document, and then the process begins, regardless of the language in which the text is written.

2, Text Similarities (Plagiarism detection)

The text is analyzed and checked for a case of text similarity in three source areas (according to the URKUND tool). Therefore, possible overlapping origins are highlighted from our archives, which contain Internet origins, published academic material, and previously submitted student documents. Candidate text similarities are studied in-depth, and the results are saved.

3. Analysis based on machine learning

When a document begins to show similarities to other sources, the basis of the report begins to take shape. We not only record the degree of coincidence but also take into account any other use of paraphrases and synonyms, in addition to other forms of substitutions. Our algorithms work independently of the language and are even capable of detecting similarities between an increasing number of languages.

4. Creation and delivery of the report

When the process ends, an overview of the analysis is generated and delivered to the teacher, either through the learning platform used, by email and through the web inbox. The results of the analysis are presented in an understandable report so that the teacher can make the final decision about whether or not plagiarism has occurred.

 

SPECIFIC ACCESS AND REUSE POLICIES

The RFJ allows authors to own the copyright without restriction.

1) The authors agree with the publication of their work (Spanish, English, French, Italian, Portuguese, German) in the RFJ.

2) The authors and third parties can freely share the work. It is very moderately requested to mention its author and the RFJ.

3) The authors are requested to collaborate and participate freely in distributing their contribution.

4) Authors can freely share their work via the Internet (for example, personal and institutional website) after the evaluation and publication process to encourage intellectual and opinion exchanges and favorably affect citations of published work.
