Abstract
ABSTRACT
The composition of the IESS Board of Directors is tripartite. In 2016, the Constitutional Court declared the deferred unconstitutionality of the second and third paragraphs of article 28 of the Social Security Law, until the National Assembly approves legal reform to ensure the constitutional rights of equality and participation for the integration of this body. As of 2018, by decision of the General Controller of the State, the IESS Board of Directors had only two members. In 2020, by decision of the Court, the Board of Directors has once again a tripartite structure. Therefore, this paper aims to analyze the current structure of the Board of Directors and other factors around the governance of the highest governing body of the Ecuadorian Social Security Institute.
